On the website www.montdarbois.edmondderothschildheritage.com, Mont d’Arbois Luxury Resort, a simplified joint stock company with a capital of 18,909,192.5 euros, whose registered office is located at 3001 route Edmond de Rothschild, 74120 Megève, registered at the Annecy RCS under number 804 503 902, whose intra-community VAT number is FR 10 804 503 902, and the insurer is MMA Entreprise, AON Conseil et Courtage, 31-35 rue de la Fédération, 75717 Paris Cedex 15, sells accommodation services within the hotel Les Chalets du Mont d’Arbois.

Accordingly, these General Terms and Conditions of Accommodations Services (hereinafter “the General Terms and Conditions”) apply to all room reservations made within Les Chalets du Mont d’Arbois hotel, made on the website www.montdarbois.edmondderothschildheritage.com (hereinafter the “Website”), by consumers or professionals (hereinafter “the Customer(s)” in the case of consumer and professional customers without distinction, “the Consumer Customer(s)” in the case of customers who are only consumers within the meaning of the first article of the Consumer Code, and “the Professional Customer(s)” in the case of professional customers within the meaning of the first article of the same Code).

The Customer declares that he/she has read the General Terms and Conditions before making the reservation. The confirmation of a reservation therefore implies acceptance without restriction or reservation of the General Terms and Conditions.

The Customer declares that he/she has full legal capacity to enter into a contract enabling him/her to abide by the General Terms and Conditions.

Article 1 – Purpose

The General Terms and Conditions define the rights and obligations of the parties when booking rooms online at Les Chalets du Mont d’Arbois.

Article 2 – Scope of Application

The General Terms and Conditions apply to any room reservation made by a Customer, on the Website, at Les Chalets du Mont d’Arbois hotel.

The Customer must confirm his/her agreement to all the General Terms and Conditions by ticking a box provided for this purpose in the reservation form on the Website before validating the reservation.

Pursuant to the provisions of article 1127-1 of the Civil Code, the General Terms and Conditions may be kept by the Customer either electronically or by means of a printout.

The General Terms and Conditions apply as long as they are available on the Website. They are subject to change. The applicable conditions are those in force on the Website at the time of booking. The date of publication of the General Terms and Conditions is the date of entry into force of the General Terms and Conditions.

Article 3 – Reservation Procedure

La procédure de réservation comprend les étapes suivantes :

  • Selecting the reservation form (which is available in French and English): you can choose the language and currency you want;

  • Entering the dates of the stay and the number of people on the reservation form;

  • Consulting and choosing the room(s) from our offers. Please note that in the event of prolonged inactivity during the booking procedure, the chosen accommodation offer may no longer be guaranteed.

  • Entering personal and banking details. At this stage, the Customer has the opportunity to check the details of the chosen offer, including the total price and the booking and cancellation conditions, before finalising the reservation.

  • Banking details are stored as a guarantee in order to confirm the reservation and for the payment of the deposit made at the time of reservation, as well as for charging the balance due at the end of the cancellation period;

  • The Customer acknowledges having read and accepted the General Terms and Conditions by ticking the box provided for this purpose, prior to validating the reservation. The customer also accepts the Personal Data Protection and Cookie Usage Policy of Les Chalets du Mont d’Arbois by checking the box provided for this purpose. The Customer also has the option to accept to receive information on new products and special offers from Les Chalets du Mont d’Arbois via a newsletter by ticking the box provided for this purpose;

  • Validating the reservation by clicking on the “Finalise reservation” button. The validation of the reservation requires the payment of a deposit corresponding to 50% of the total price of the stay, unless otherwise specified in the offer as well as at the time of payment. Validation of the reservation also implies the Customer’s consent to the deduction of the balance due at the end of the cancellation period.

Article 4 – Confirmation of Receipt of the Reservation

Once the Customer has validated the reservation, he/she will immediately receive a summary confirmation of the reservation by e-mail.

Article 5 – Reservation and Cancellation Conditions

You will find below the conditions for booking and cancelling our “standard” offers in the low season (i.e., excluding French and European school holidays) and in the high season (i.e., during French and European school holidays).

Reservation and cancellation conditions different from those set out in this article may be provided for our special offers and rates, including our non-cancellable and non-refundable special offers. Such conditions will then be specified in the details of the offer and at the time of booking validation.

Article 5.1 – Reservation and Cancellation Conditions

  • Low season (excluding French and European school holidays)

If the reservation is made more than thirty days before the start date of the stay, the Customer pays, at the time of booking, a deposit corresponding to 50% of the total price of the stay, including taxes and service charges, excluding tourist tax.

The Customer pays the balance of the price thirty days before the start date of the stay.

If the reservation is made less than thirty days before the start date of the stay, the full price of the stay is paid at the time of booking.

Any cancellation of the reservation must be indicated before 6 p.m. (Megève local time) at the following number 04 50 21 25 03 and/or by email at conciergerie@edrh-montdarbois.com, at the latest thirty days before the scheduled arrival date. If these conditions are met, the Customer will be refunded the deposit paid to guarantee the reservation as well as the remaining balance, if it has already been paid by the Customer.

If cancellation is made less than thirty days before the arrival date, the full amount of the booking – including the deposit and the balance of the price – will be due and charged, and the full amount of the payment will be kept.

Likewise, in the event that no cancellation is made and the Customer is a no-show, the full amount of the booking – including the deposit and the balance of the price – will be due and charged, and the full amount of the payment will be kept.

  • High season (during French and European school holidays)

If the reservation is made more than sixty days before the start date of the stay, the Customer pays, at the time of booking, a deposit corresponding to 50% of the total price of the stay, including taxes and service charges, excluding tourist tax.

The Customer pays the balance of the price sixty days before the start date of the stay.

If the reservation is made less than sixty days before the start date of the stay, the full price of the stay is paid at the time of booking.

Any cancellation of the reservation must be indicated before 6 p.m. (Megève local time) at the following number 04 50 21 25 03 and/or by email at conciergerie@edrh-montdarbois.com, at the latest sixty days before the scheduled arrival date. If these conditions are met, the Customer will be refunded the deposit paid to guarantee the reservation as well as the remaining balance, if it has already been paid by the Customer.

If cancellation is made less than sixty days before the arrival date, the full amount of the booking – including the deposit and the balance of the price – will be due and charged, and the full amount of the payment will be kept.

Article 5.2 – No Withdrawal

The Consumer Customer is reminded that, in accordance with Article L. 221-28, 12° of the Consumer Code, he/she does not have the right to withdraw from the contract provided for in Article L. 221-18 of the Consumer Code.

Article 5.3 – Modification of the Reservation

  • Low season (excluding French and European school holidays)

Any reservation changes must be indicated before 6 p.m. (Megève local time) to the following number 04 50 21 25 25 03 and/or by email to conciergerie@edrh-montdarbois.com, at the latest thirty days before the scheduled arrival date. Acceptance of the modification will be at the discretion of Mont d’Arbois Luxury Resort, depending on room availability.

In the event that the stay is shortened or postponed by the Customer less than thirty days before the arrival date, the Mont d’Arbois Luxury Resort may charge the Consumer Customer the full amount of the stay as compensation if it is unable to sell the room to another customer.

For any other modification request made less than thirty days before the arrival date, the acceptance of the modification will be at the discretion of Mont d’Arbois Luxury Resort, depending on room availability.

  • High season (during French and European school holidays)
  • Any reservation changes must be indicated before 6 p.m. (Megève local time) to the following number 04 50 21 25 25 03 and/or by email to
    conciergerie@edrh-montdarbois.com, at the latest sixty days before the scheduled arrival date. Acceptance of the modification will be at the discretion of Mont d’Arbois Luxury Resort, depending on room availability.

    In the event that the stay is shortened or postponed by the Customer less than sixty days before the arrival date, the Mont d’Arbois Luxury Resort may charge the Consumer Customer the full amount of the stay as compensation if it is unable to sell the room to another customer.

    For any other modification request made less than sixty days before the arrival date, the acceptance of the modification will be at the discretion of Mont d’Arbois Luxury Resort, depending on room availability.

    • Special offers and rates

    For special offers and rates, there may be conditions for modifying the reservation different from those set out in this article. Such conditions will then be specified in the offer details and when the reservation is validated.

    Article 6 – Prices

    The price listed includes only the reservation of the rooms, excluding any additional services (spa, meals, etc.), which will be separately booked and charged.

    The price of the rooms/nights quoted includes all taxes, except tourist tax, in the chosen currency.

    The tourist tax is to be paid, in addition, on site.

    Article 7 – Payment Terms

    Article 7.1 – Payment Terms Common to Both Consumer and Professional Customers

    The Customer provides his/her banking details to guarantee the reservation and for the payment of the deposit, except in the case of special conditions or rates, by credit or debit card (Visa, MasterCard, American Express, etc.), indicating the card number and its expiration date (the card used must be valid at the time of stay) directly in the field provided and the visual cryptogram (secure entry using SSL encryption).

    On the day of arrival at Les Chalets du Mont d’Arbois, the Customer must present the credit card used to guarantee the reservation or to make the payment. An identity document may also be requested for the purpose of preventing credit card fraud.

    The payment of the deposit is made online at the time of booking.

    If the Customer wishes to use another means of payment, a specific request must be made by leaving a message in the “specific requests” section provided for this purpose in the reservation form.

    The balance of the price is paid at the end of the cancellation period, by credit card.

    In some cases, special offers and rates require prepayment of the full price at the time of booking.

    Article 7.2 – Specific Payment Terms for Professional Customers

    Only the payment on the agreed due date is conclusive. Pursuant to the provisions of Article L. 441-6 of the French Commercial Code, any failure by the Professional Customer, in whole or in part, to fulfil his/her payment obligations, or any delay in doing so, shall automatically result in a penalty of three times the legal interest rate in force on the due date, as well as the fixed compensation for recovery costs of €40 provided for in the said article. It is specified that this fixed indemnity is not limited to the amount of any other costs that may be incurred by Mont d’Arbois Luxury Resort for the purpose of collecting payments.

    Interest will begin to accrue from the date of payment indicated on the invoice and will continue to accrue until the day of full payment of all amounts due to Mont d’Arbois Luxury Resort.

    Article 8 – Conditions of Accommodation

    Upon arrival at Les Chalets du Mont d’Arbois, the Customer will be asked to present an identity document and, if applicable, to complete a police card, in accordance with Article R.611-42 of the Code de l’entrée et du séjour des étrangers et du droit d’asile (CESEDA).

    The personal data collected as part of the police record are kept for a period of six months. This is done in the interests of public order, criminal investigations and searches for individuals. In this context, they may be forwarded to the police or gendarmerie, at their request.

    Guest rooms must be vacated before 12:00 noon. In case of late departure, please contact the reception.

    We will do our best to ensure that the rooms are ready as soon as possible. However, they will not be available until 4 p.m.

    In addition, you will need to inform us if your arrival is scheduled for after 6 p.m., by contacting us by telephone at 04 50 21 25 03 or by e-mail at the following address: conciergerie@edrh-montdarbois.com.

    As far as animals are concerned, dogs are welcome except for dangerous breeds, as listed by law.

    Article 9 – Guarantees

    With regard to Consumer Customers, excluding Professional Customers, Mont d’Arbois Luxury Resort is bound by the guarantee of conformity of services, under the conditions set out in Articles L. 411-1 and following of the Consumer Code.

    Article 10 – Liability

    Although Mont d’Arbois Luxury Resort does its best to ensure that the photographs on the Website reflect as accurately as possible the accommodation services offered, these photographs have no contractual value. Thus, variations can occur in the event of renovations or furniture modifications, for example. Its liability can in no case be engaged in case of minor variations.

    Mont d’Arbois Luxury Resort may not be held liable for the non-execution or improper execution of the reservation in the event of force majeure, by a third party, by a partner of Mont d’Arbois Luxury Resort, by the Customer, and in particular in the event of unavailability of the Internet network, inability to access the Website, external intrusion, or computer viruses.

    Any reservation or payment that is irregular, inoperative, incomplete or fraudulent for a reason attributable to the Customer will result in the cancellation of the reservation at the Customer’s expense, without prejudice to any civil or criminal action against the latter.

    Mont d’Arbois Luxury Resort declines all responsibility in the event of theft, loss or damage to the belongings of Customers during their stay.

    Article 11 – Complaints/Customer Service

    For information or complaints about these General Terms and Conditions of Accommodations Services, Customers should contact Mont d’Arbois Luxury Resort’s Customer Service at the following telephone number 04 50 21 25 03, and/or the following e-mail address conciergerie@edrh-montdarbois.com, quoting their reservation number, if applicable.

    Article 12 – Relocation

    In the event of an exceptional event, or if it is impossible to provide the room reserved for the Customer, or in the event of force majeure, Les Chalets du Mont d’Arbois may offer the Customer accommodation in a hotel of at least the same category or, if it is of a lower category, a room of a higher level than the one originally reserved, for services of the same nature. Any additional costs associated with this relocation, for services of the same nature, will be covered by Mont d’Arbois Luxury Resort, without it being possible to seek any additional compensation.

    In the exceptional case where the hotel cannot find an equivalent alternative accommodation solution as indicated above, excluding cases of force majeure, Mont d’Arbois Luxury Resort may cancel the reservation by refunding the Customer twice the deposit and the balance of the price, if the latter has been paid. 

    Article 13 – Protection of Privacy – Personal Data

    With regard to Mont d’Arbois Luxury Resort’s compliance with the regulations in force governing the protection of personal data during the collection and processing of Customer personal data in the reservation form, please refer to the “Personal Data Protection and Cookie Usage Policy of Les Chalets du Mont d’Arbois Hotel”.

    In addition, in accordance with article L.223-1 of the Consumer Code, the Consumer Customer may register on a list opposing BLOCTEL telephone solicitation.

    Article 14 – Intellectual Property Rights

    The reproduction for information purposes of any elements of the offers of the Les Chalets du Mont d’Arbois hotel present on the Website (for example by printing a page containing the details of an offer) is authorised provided that it is for strictly personal and private use.

    However, any reproduction and, in general, any use of copies of elements included in the offers of the Les Chalets du Mont d’Arbois hotel present on the Website made for other purposes is strictly prohibited, unless prior written consent is obtained from Mont d’Arbois Luxury Resort.

    With regard to the intellectual property rights held by Mont d’Arbois Luxury Resort on the content of the Website, please refer to the provisions of Article 3 entitled “Intellectual Property Rights” of the General Terms and Conditions of Website Use.

    Article 15 – Force Majeure

    The fulfilment by Mont d’Arbois Luxury Resort of all or part of its obligations shall be suspended in the event of a case of force majeure that would hinder or delay its execution.

    Force majeure refers to any event beyond the control of Mont d’Arbois Luxury Resort which could not reasonably have been foreseen at the time of booking and whose effects cannot be avoided by appropriate measures, pursuant to Article 1218 of the Civil Code.

    Mont d’Arbois Luxury Resort will inform the Customer of the occurrence of a case of force majeure within eight (8) days of its occurrence. If the suspension of the obligations continues beyond fifteen (15) days, the Customer or Mont d’Arbois Luxury Resort could then cancel the existing reservation and proceed with a refund.

    Article 16 – Agreement on Proof

    Entering the required banking information, as well as accepting the General Terms and Conditions and validating the reservation, constitutes acceptance of the hotel contract between the parties, and has the same value as a handwritten signature.

    Article 17 – Applicable Law – Dispute Resolution – Mediation

    The General Terms and Conditions concerning reservations are governed by French law.

    In the event of a dispute, the French version of the reservation form is authoritative.

    Should there be any dispute relating to these General Terms and Conditions or any litigation arising therefrom, the Customer must send his/her claims in writing to Mont d’Arbois Luxury Resort Customer Service by registered mail with return receipt to the following address: 3001 route Edmond de Rothschild, 74120 Megève.

    Article 17.1 – Specific Provisions Applicable to the Consumer Customer

    In the event of failure to reply to the complaint or in the event of its failure, within three (3) months from the date of receipt, the Consumer Customer may, at no cost, refer the matter to the consumer mediator to whom the Mont d’Arbois Luxury Resort company is subject, the Association des Médiateurs Européens (AME CONSO), within one year of the written complaint addressed to Mont d’Arbois Luxury Resort.

    The consumer mediator must be notified:

    • either by completing the appropriate form on the AME CONSO website: www.mediationconso-ame.com ;

    • or by letter addressed to AME CONSO, 11 Place Dauphine, 75001 PARIS.

    The mediator will attempt, independently and impartially, to bring the parties to a mutually acceptable solution, in accordance with Articles L. 611-1 and following of the Consumer Code. The Consumer Customer remains free to initiate, accept or refuse the use of mediation. In the event of mediation, the parties remain free to accept or refuse the solution proposed by the mediator.

    In the event of failure of mediation or any other means of out-of-court settlement, the dispute shall be submitted to the jurisdiction of the competent French courts designated pursuant to French procedural rules.

    Article 17.2 – Specific Provisions Applicable to the Professional Customer

    In the event of failure to reply to the complaint or in the event of its failure, within three (3) months from the date of receipt, or in the event of failure of any other attempt to resolve the dispute amicably, the dispute shall be submitted to the exclusive jurisdiction of the Commercial Court of the registered office of Mont d’Arbois Luxury Resort.

    On this website, the Société Française des Hôtels de Montagne SFHM sells accommodations services within the hotel La Ferme du Golf.

    • Consulting and choosing the room(s) from our offers. Please note that in the event of prolonged inactivity during the booking procedure, the chosen accommodation offer may no longer be guaranteed. In this case, a message indicating “Session expired” will be displayed and the Customer must repeat the reservation procedure from the beginning;

    • Review of the summary of the chosen offer: the Customer has the possibility to check the details of the chosen offer, in particular the total price and the booking and cancellation conditions, before finalising the reservation;

    • Entry of personal and banking details. Possibility to create/use a user account; creating an account is optional, however;

    • Banking details are used to confirm the reservation and to pay the deposit, which is made at the time of booking. Pre-authorisation or debit of your card may also occur at a later date in accordance with the provisions set out below in Article 7 “Payment Terms”;

    • The Customer acknowledges having read and accepted the General Terms and Conditions by ticking the box provided for this purpose before validating the reservation. The customer also accepts the Personal Data Protection and Cookie Usage Policy of La Ferme du Golf by checking the box provided for this purpose.

    • Validating the reservation. Validation entails a payment obligation in accordance with the provisions set out below in Article 7 “Payment Terms”, unless special conditions are specified in the offer and at the time of payment.

    Article 4 – Confirmation of Receipt of the Reservation

    Once the Customer has validated the reservation, he/she will immediately receive a summary confirmation of the reservation by e-mail.

    Article 5 – Reservation and Cancellation Conditions

If these conditions are met, the Customer will be refunded the deposit paid to guarantee the reservation.

    In the event of cancellation less than thirty days before the arrival date, the Customer will forfeit the deposit, which will be retained by the Société Française des Hôtels de Montagne SFHM.

    In the event of cancellation of the stay on the same day and/or in the event of a no-show by the Customer, the full amount of the booking – including the deposit and the balance of the price – will be due and charged.

    • High season (during French and European school holidays)

    If the reservation is made more than thirty days before the start date of the stay, the Customer pays, at the time of booking, a deposit corresponding to 50% of the total price of the stay, including taxes and service charges, excluding tourist tax.

    The Customer pays the balance of the price thirty days before the start date of the stay.

    If the reservation is made less than thirty days before the start date of the stay, the full price of the stay is paid at the time of booking.

    Any cancellation of the reservation must be indicated before 6 p.m. (Megève local time) at the following number +33 4 50 21 14 62 and/or by email at fermedugolf@edrh-montdarbois.com, at the latest thirty days before the scheduled arrival date. If these conditions are met, the Customer will be refunded the deposit paid to guarantee the reservation.

    If cancellation is made less than thirty days before the arrival date, the full amount of the booking – including the deposit and the balance of the price – will be due and charged, and the full amount of the payment will be kept.

    As for any other change requests within a period of less than thirty days before the arrival date, acceptance will be made at the discretion of the Société Française des Hôtels de Montagne SFHM, depending on the availability of the rooms.

    Article 6 – Prices

    The price listed includes only the reservation of the rooms, excluding any additional services (spa, meals, etc.), which will be separately booked and charged.

    The price of the rooms/nights quoted, in the chosen currency, excludes the tourist tax.

    The tourist tax is to be paid, in addition, on site. It is mentioned on the reservation form when the booking summary is shown.

    Article 7 – Payment Terms

    The Customer provides his/her banking details to guarantee the reservation and for the payment of the deposit, except in the case of special conditions or rates, by credit or debit card (Visa, MasterCard, American Express only) – using the online platform – indicating the card number and its expiration date (the card used must be valid at the time of stay), as well as the visual cryptogram, directly in the field provided.

    On the day of arrival at La Ferme du Golf, the Customer must present the credit card used to guarantee the reservation or to make the payment. An identity document may also be requested for the purpose of preventing credit card fraud.

    The customer authorises the hotel to charge his/her credit card for the payment of the deposit at the time of booking.

    The payment of the balance of the price is made:

    • at the hotel during the stay in low season by credit card (EMV system), or cheque, or in cash within the legal limit,

    • 30 days before the arrival date, by credit card (online platform) in high season,

    • except for special offers and rates which stipulate a prepayment of the full price at the time of booking by credit card used to guarantee the booking.

    Article 8 – Conditions of Accommodation

    Upon arrival at La Ferme du Golf, the Customer will be asked to present an identity document and, if applicable, to complete a police card, in accordance with Article R.611-42 of the Code de l’entrée et du séjour des étrangers et du droit d’asile (CESEDA).

    The personal data collected as part of the police record are kept for a period of six months. This is done in the interests of public order, criminal investigations and searches for individuals. In this context, they may be forwarded to the police or gendarmerie, at their request.

    Guest rooms must be vacated before 12:00 noon.

    We will do our best to ensure that the rooms are ready as soon as possible. However, they will not be available until 4 p.m.

    In addition, you will need to inform us if your arrival is scheduled for after 6 p.m., by contacting us by telephone at +33 4 50 21 14 62 or by e-mail at fermedugolf@edrh-montdarbois.com.

    As far as animals are concerned, dogs are welcome except for dangerous breeds, as listed by law. A surcharge of 10 euros per animal per day will be charged (food not included).

    Article 9 – Guarantees

    La Ferme du Golf is bound by the guarantee of conformity of services, under the conditions set out in Articles L. 411-1 and following of the Consumer Code.

    Article 10 – Liability

    Although the Société Française des Hôtels de Montagne SFHM does its best to ensure that the photographs on the Website reflect as accurately as possible the accommodation services offered, these photographs have no contractual value. Thus, variations can occur in the event of renovations or furniture modifications, for example. Its liability can in no case be engaged in case of minor variations.

    The Société Française des Hôtels de Montagne SFHM may not be held liable for the non-execution or improper execution of the reservation in the event of force majeure, by a third party, by a partner of Société Française des Hôtels de Montagne SFHM, by the Customer, and in particular in the event of unavailability of the Internet network, inability to access the Website, external intrusion, or computer viruses.

    Any reservation or payment that is irregular, inoperative, incomplete or fraudulent for a reason attributable to the Customer will result in the cancellation of the reservation at the Customer’s expense, without prejudice to any civil or criminal action against the latter.

    The Société Française des Hôtels de Montagne SFHM declines all responsibility in the event of theft, loss or damage to the belongings of Customers during their stay.

    Article 11 – Complaints/Customer Service

    For information or complaints about these General Terms and Conditions of Accommodations Services, Customers should contact the Société Française des Hôtels de Montagne SFHM Customer Service at the following telephone number +33 4 50 21 14 62, and/or by email at fermedugolf@edrh-montdarbois.com, quoting their reservation number, if applicable.

    Article 12 – Relocation

    In the event of an exceptional event, or if it is impossible to provide the room reserved for the Customer, or in the event of force majeure, La Ferme du Golf may offer the Customer accommodation in a hotel of at least the same category or, if it is of a lower category, a room of a higher level than the one originally reserved, for services of the same nature. Any additional costs associated with this relocation, for services of the same nature, will be covered by Société Française des Hôtels de Montagne SFHM, without it being possible to seek any additional compensation.

    In the exceptional case where the hotel cannot find an equivalent alternative accommodation solution as indicated above, excluding cases of force majeure, the Société Française des Hôtels de Montagne SFHM may cancel the reservation by refunding the Customer twice the deposit and the balance of the price, if the latter has been paid.

    Article 13 – Protection of Privacy – Personal Data

    With regard to Société Française des Hôtels de Montagne SFHM’s compliance with the regulations in force governing the protection of personal data during the collection and processing of Customer personal data in the reservation form, please refer to the “Personal Data Protection and Cookie Usage Policy of La Ferme du Golf Hotel”.

    In addition, in accordance with article L.223-1 of the Consumer Code, the Customer may register on a list opposing BLOCTEL telephone solicitation.

    Article 14 – Intellectual Property Rights

    The reproduction for information purposes of any elements of the offers of the La Ferme du Golf hotel present on the Website (for example by printing a page containing the details of an offer) is authorised provided that it is for strictly personal and private use.

    However, any reproduction and, in general, any use of copies of elements included in the offers of the La Ferme du Golf hotel present on the Website made for other purposes is strictly prohibited, unless prior written consent is obtained from Société Française des Hôtels de Montagne SFHM.

    With regard to the intellectual property rights held by Société Française des Hôtels de Montagne SFHM on the content of the Website, please refer to the provisions of Article 3 entitled “Intellectual Property Rights” of the General Terms and Conditions of Website Use.

    Article 15 – Force majeure

    The fulfilment by Société Française des Hôtels de Montagne SFHM of all or part of its obligations shall be suspended in the event of a case of force majeure that would hinder or delay its execution.

    Force majeure refers to any event beyond the control of Société Française des Hôtels de Montagne SFHM which could not reasonably have been foreseen at the time of booking and whose effects cannot be avoided by appropriate measures, pursuant to Article 1218 of the Civil Code.

    The Société Française des Hôtels de Montagne SFHM will inform the Customer of the occurrence of a case of force majeure within eight (8) days of its occurrence. If the suspension of the obligations continues beyond fifteen (15) days, the Customer or Société Française des Hôtels de Montagne SFHM could then cancel the existing reservation and proceed with a refund.

    Article 16 – Agreement on Proof

    Entering the required banking information, as well as accepting the General Terms and Conditions and validating the reservation, constitutes acceptance of the hotel contract between the parties, and has the same value as a handwritten signature.

    Article 17 – Applicable Law – Dispute Resolution – Mediation

    The General Terms and Conditions concerning reservations are governed by French law.

    In the event of a dispute, the French version of the reservation form is authoritative.

    Should there be any dispute relating to these General Terms and Conditions or any litigation arising therefrom, the Customer must send his/her claims in writing to Société Française des Hôtels de Montagne SFHM Customer Service by registered mail with return receipt to the following address: 47 rue du Faubourg Saint-Honoré, 75008 Paris.

    In the event of failure to reply to the complaint or in the event of its failure, within three (3) months from the date of receipt, the Customer may, at no cost, refer the matter to the consumer mediator to whom the Société Française des Hôtels de Montagne SFHM is subject, the Association des Médiateurs Européens (AME CONSO), within one year of the written complaint addressed to the Société Française des Hôtels de Montagne SFHM.

    The consumer mediator must be notified:

    • either by completing the appropriate form on the AME CONSO website: www.mediationconso-ame.com;

    • or by letter addressed to AME CONSO, 11 Place Dauphine, 75001 PARIS.

    The mediator will attempt, independently and impartially, to bring the parties to a mutually acceptable solution, in accordance with Articles L. 611-1 and following of the Consumer Code. The Customer remains free to initiate, accept or refuse the use of mediation. In the event of mediation, the parties remain free to accept or refuse the solution proposed by the mediator.

    In the event of failure of mediation or any other means of out-of-court settlement, the dispute shall be submitted to the jurisdiction of the competent French courts designated pursuant to French procedural rules.

    Participating in a competition demands the strict respect of the following conditions :

    • The players will be able to choose one of the predefined time slots in the limit of the spaces available in each slot, the starts will be staggered by ascending order of handicaps.
    • Requests for a specific start time will not be allowed.
    • Any participant who is not a member of the Club must present their F.F.G. licence for the year underway and a medical certificate or, for non-French participants, their up-to-date handicap record.
    • The competitors must present themselves to the starter at the latest 5 minutes before their start time.
    • Arriving up to 5 minutes late incurs a 2-shot penalty.
    • During all paired competitions, the participants start from yellow and red markers.
    • Registration for Sunday competitions closes at midday on Saturday.
    • If competitors cancel their participation after the online publishing of the start times they will be forbidden from participating in the following official competition.
    • After Saturday evening, any absence will mean that the competitor concerned will be forbidden from participating in the following 2 official competitions (or the day before or two days before for weekday competitions).
    • Any round that exceeds the time limit for completing the 18 holes, set by the Sporting Committee, incurs a 2-shot penalty.
    • During the prize giving ceremony, any prize winners who are absent miss their chance to be attributed their prize. For team competitions, the team must be represented by at least one of its members.

    Remember!

    A medical certificate is mandatory in order to participate in the Club’s official competitions. A minimum handicap of 36.5 is required.

    The Sporting Committee reserves the right to change the competition dates, to cancel them or to modify the conditions.

    Don’t forget that a last minute absence is disrespectful to the other competitors and could disturb the smooth running of the competition.
